 Shapes Fitness Centres ("Shapes") is committed to protecting your privacy.

 

This Privacy Statement provides you with information about Shapes' practices relating to the collection, use and disclosure of personal information and explains how you can contact Shapes if you have a question about, want to make a change to, or delete any personal information that Shapes may be holding about you. Accountability

Shapes is responsible for your personal information under its control. We have appointed a Privacy Officer who is accountable for the Shape's compliance with this Privacy Policy.

For the purpose of this Privacy Statement, 11personal information 11 means information that can be used to identify and/ or contact you as an individual.

 

Shapes may collect the following personal information:

• Contact information (such as name, mailing address, e-mail address and telephone numbers and the like);

• Information about your fitness interests, fitness goals and general fitness state;

• Proof of identity (such as a signature, driver 1s license number, birthdate, etc.);

• Financial and billing information (such as credit card number, expiration date and/ or bank account information);

• Demographic information (e.g. gender);

• Information regarding your visit history to Shapes' clubs.

• Correspondence and notes of communications with you.

• Name of employer (if you are seeking services under a corporate membership).

• Emergency information (such as contact information and medical number). Shapes uses personal information to:

• Provide you with the services and related products you request, do all the things necessary to administer those services and products and to research, develop, manage, improve and personalize those services and products;

• Develop and maintain its relationship with you and communicate with you;

• Bill you for our services and related products; and

• Advise you about additional services and products offered by Shapes that may be of interest to you.

• For emergency purposes.

 

Information about your employer is used to confirm your eligibility for services under a corporate membership.

 

Shapes may also use personal information to create aggregate information (information from which personal identifiers have been removed). Aggregate information helps Shapes to understand its customer needs and assists in developing new services and products.

 

Shapes may share personal information with third parties engaged to assist it in providing services or products to you or to carry out one or more of the purposes described above. These service providers are prohibited from using personal information for any purpose other than to provide this assistance and are required to protect personal information disclosed to them by Shapes and to comply with the general privacy principles described in this Privacy Statement.

Shapes does not sell member information to others.

Shapes makes commercially reasonable efforts to ensure that personal information relating to you is protected against loss and unauthorized access. This protection applies in relation to information stored in both electronic and hard copy form.

In addition, Shapes employs generally accepted information security techniques, such as access control procedures in order to protect personal information against loss and unauthorized access.

 

In connection with the operation of the website located at www.shapes.ca, Shapes makes use of firewalls and supports Secure Socket Layer (11SSL11) encryption technology.

 

Your personal information is secure with Shapes. We have comprehensive security controls to protect against non-authorized access, use, alteration, duplication, destruction, or disclosure. We protect your personal information by using safeguards that are appropriate to the sensitivity of the information.

 

Each of our employees is responsible for maintaining the confidentiality and security of all personal information to which they have access. We keep our employees informed about our policies and procedures for protecting personal information. Where necessary, our employees are required to sign agreements to keep your personal information confidential.

• A government agency which can oblige us to do so;

• Emergency personnel in emergency situations in which life, health or safety of a member is in danger;

• An agent retained by Shapes in connection with the collection of your account;

• A parent if you are under the age of 18.

 

Shapes also reserves the right to disclose and/ or transfer personal information to a third party in the event of a proposed or actual purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal or financing of all or any portion of Shapes or of any of the business or assets or shares of Shapes or a division thereof in order for you to continue to receive the same services and products from the third party.

Shapes collects personal information relating to you only when you voluntarily provide it. Shapes will not disclose your personal information for any purpose other than those for which it was collected, except with your consent or as required or authorized by law.

 

When you become a member of Shapes, you consent to the use of your personal information for the purposes listed above. You may refuse or withdraw your consent at any time; however we may not then be able to provide you with our full range of services. We will advise you when you refuse or withdraw your consent what impact that will have on what we are able to provide. Retention of Personal Information

 

Shapes retains personal information for as long as necessary to fulfill the purpose(s) for

 

which it was collected and to comply with applicable laws and your consent to such purpose remains valid after termination of Shapes' relationship with you. Personal information is stored in a secure facility until such time as it is no longer required, after which it is destroyed.
